PalcoTV DMCA Policy

1. Introduction
PalcoTV ("PalcoTV," "we," "us," or "our") respects the intellectual property rights of others and expects users of the PalcoTV platform to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. Section 512.
PalcoTV is a live streaming platform where streamers broadcast their own reaction content (camera and voice) while viewers watch sporting events on their own separate applications. PalcoTV does not host, rebroadcast, or transmit copyrighted sports match footage. Streamers who rebroadcast copyrighted match footage are in violation of our Terms of Service and Community Guidelines, and their content will be removed.

3. How to File a DMCA Takedown Notice
If you believe that content on PalcoTV infringes your copyright, you may submit a written notification to our DMCA Designated Agent. Your notification must include ALL of the following information, as required by 17 U.S.C. Section 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit PalcoTV to locate the material. This should include:
- The streamer's username;
- The stream title or stream ID (if known);
- The date and approximate time of the alleged infringement;
- A description of the infringing content.
- Contact information for the complaining party, including name, address, telephone number, and email address.
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We aim to process all valid takedown notices within twenty-four (24) hours of receipt for live content and within seventy-two (72) hours for recorded content.
Note: Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer or by PalcoTV.
4. PalcoTV's Response to Takedown Notices
Upon receiving a valid DMCA takedown notice, PalcoTV will:
- Remove or disable access to the allegedly infringing material promptly. For live streams, this may include immediate termination of the stream.
- Notify the streamer that their content has been removed or their stream has been terminated due to a copyright infringement claim. The notification will include the name of the complaining party and the nature of the claim.
- Provide the streamer with information about how to submit a counter-notification if they believe the takedown was issued in error.
- Log the action in our moderation audit system, including the date of the notice, the complaining party, the content removed, and the action taken.
5. Counter-Notification Process
If you are a streamer whose content has been removed or whose stream has been terminated due to a DMCA takedown notice and you believe the removal was a mistake or that you have authorization to use the content, you may submit a counter-notification to our DMCA Designated Agent.
Your counter-notification must include ALL of the following, as required by 17 U.S.C. Section 512(g)(3):
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled (e.g., stream title, date, and time).
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which PalcoTV may be found), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.
After We Receive Your Counter-Notification
Upon receiving a valid counter-notification, PalcoTV will:
- Forward a copy of the counter-notification to the original complaining party.
- Inform the complaining party that PalcoTV will restore the removed material or re-enable access within ten (10) business days.
- Restore the material or re-enable access within ten (10) to fourteen (14) business days after receiving the counter-notification, UNLESS PalcoTV first receives notice from the complaining party that they have filed a court action seeking to restrain the streamer from engaging in infringing activity.
6. Repeat Infringer Policy
PalcoTV maintains a policy of terminating the accounts of users who are repeat infringers of copyright, in appropriate circumstances. Our policy is as follows:
6.1 Strike Counting for Copyright Violations
Copyright infringement strikes are tracked separately from Community Guidelines strikes but contribute to the same overall account standing:
- First DMCA strike: Warning and content removal. Streamer is notified and educated about copyright rules.
- Second DMCA strike: Content removal and 7-day streaming suspension. Streamer must re-accept Community Guidelines upon return.
- Third DMCA strike: Permanent termination of the streamer's account.
6.2 Strike Resolution
A DMCA strike is removed from a streamer's record if:
- The counter-notification process results in the material being restored (i.e., the complaining party does not file a court action within the statutory period);
- The complaining party withdraws the takedown notice; or
- PalcoTV determines, in its sole discretion, that the takedown notice was clearly invalid.
6.3 Live Stream Termination
Because PalcoTV is a live streaming platform, infringing content may be broadcast in real time. If PalcoTV becomes aware (through a DMCA notice, internal monitoring, or viewer report) that a live stream contains infringing content:
- The stream will be terminated immediately;
- The streamer will receive a DMCA strike;
- If the infringement is match rebroadcasting (displaying copyrighted sports broadcast footage), the streamer will also receive a Community Guidelines strike for match rebroadcasting, which is a separate violation.
7. Safe Harbor
PalcoTV claims safe harbor protection under DMCA Section 512(c) for content stored at the direction of users. PalcoTV:
- Does not have actual knowledge that the material on the Service is infringing;
- Is not aware of facts or circumstances from which infringing activity is apparent;
- Acts expeditiously to remove or disable access to material upon receiving proper notification of claimed infringement;
- Does not receive a financial benefit directly attributable to the infringing activity (where PalcoTV has the right and ability to control such activity);
- Has designated an agent to receive notifications of claimed infringement and registered that agent with the U.S. Copyright Office.
PalcoTV is not responsible for the content that streamers broadcast. Streamers are independent creators who control their own content. PalcoTV does not pre-screen, edit, or direct streamer content.
8. Broadcasting Rights and Sports Content
PalcoTV takes a strong position against the unauthorized rebroadcasting of copyrighted sports content. This is distinct from general DMCA claims and is addressed specifically due to the nature of our platform.
8.1 PalcoTV's Position
PalcoTV is a reaction platform, not a rebroadcasting platform. Streamers show their own face and reaction; viewers watch the sporting event on their own separate application. PalcoTV does not host, distribute, or transmit copyrighted sports match footage.
8.2 Proactive Measures
- Our Community Guidelines explicitly prohibit match rebroadcasting;
- Streamers must accept the Community Guidelines (including the match rebroadcasting prohibition) before their first broadcast;
- Viewers can report suspected match rebroadcasting through the in-app reporting system;
- PalcoTV will terminate streams that contain match footage upon becoming aware of the violation.
8.3 Cooperation with Rights Holders
PalcoTV cooperates with sports leagues, broadcasters, and rights holders. If you are a rights holder or authorized representative and wish to report suspected rebroadcasting of your copyrighted content, please contact us at [email protected].
9. Misrepresentation Warning
Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
If you are unsure whether the content you wish to report actually infringes your copyright, we recommend consulting an attorney before filing a takedown notice.
10. Other Intellectual Property Concerns
This DMCA Policy specifically addresses copyright infringement claims. If you have concerns about other intellectual property violations (trademark infringement, trade secret misappropriation, etc.), please contact us at [email protected]. These concerns are handled separately from the DMCA process.
11. Changes to This Policy
PalcoTV may update this DMCA Policy from time to time. We will post the updated policy at https://palcotv.app/dmca and update the "Effective Date" at the top of this document. Material changes will be communicated through the Service or by email.
